Custodial death happens more than we like to think about. Each year, almost one thousand people die in jails, prisons, or police custody. More often than not, these deaths go unremarked by all but the victim’s family.

Most of these deaths are due to natural causes. But some of them could have–and should have–been prevented by law enforcement officers, including prison guards.

Wrongful death in jail and police custody does not have to go unanswered. If your loved one died a preventable death in custody, we can help.

What Can I Do If My Loved One Died In Custody?

If your loved one died in custody, you have a few options.

First, you can file a report with the police department, jail, or agency you believe to be responsible for their death. The agency will conduct an internal investigation, and the people involved may face disciplinary action.

You can also choose to file criminal charges yourself. Your District Attorney decides whether to pursue those charges, and they may elect not to prosecute. They do not frequently punish their own so publicly.

You can also find a civil rights lawyer and have them file a civil suit. This is often the best option for justice, and a good lawyer will be able to do more than just file the suit–they can get the media attention your loved one deserves.
